Yes — you may operate a PV system in Germany without claiming EEG remuneration. The EEG payment is a right you can waive, not a duty you must accept, but the registration, grid-connection and metering obligations stay in place either way.

Short answer: yes, you can waive EEG payment

Nobody forces you to take the statutory feed-in tariff. You can register your system in the so-called "other direct marketing" (sonstige Direktvermarktung) route, sell your surplus under a private PPA, or feed in nothing at all (zero-feed-in setup). What you cannot do is skip the technical and registration rules — those follow from grid-connection law and the metering rules, not from the subsidy scheme.

"Without EEG" means one of four different things

Clarify which one you mean before you sign anything. (1) No EEG tariff, surplus sold commercially — you keep the grid connection but market the power yourself or via a trader. (2) Zero feed-in — the inverter is limited so nothing enters the public grid; you only consume on site. (3) Off-grid / island system — no public grid connection at all, therefore no EEG relevance and no grid fees, but you carry the full storage cost. (4) Post-EEG ("Ü20") systems whose 20-year support period has expired and that now run on market terms.

What stays mandatory even without EEG money

Registration in the Marktstammdatenregister (MaStR) is required for every PV system, including zero-feed-in and battery-only setups. The connection must be notified to and approved by your grid operator under the low-voltage connection rules (VDE-AR-N 4105; larger systems fall under VDE-AR-N 4110). A metering concept agreed with the grid operator and metering point operator is needed as soon as generation, consumption and any storage share one connection point. Building and fire-safety rules apply unchanged.

Where the money comes from instead of the tariff

Self-consumption is the strongest lever, because every kilowatt-hour you use yourself replaces a retail price rather than a feed-in price. Adding a battery typically shifts cheap midday power into the evening — our BESS Academy model for a 10 kWp system with a 10 kWh battery shows self-consumption moving from roughly 30% to over 70%. Beyond that: a PPA with a commercial offtaker, exchange-based marketing through a trader, or supplying tenants and users in the same building under §42b EnWG (Solarpaket I, in force since May 2024), which — unlike the older Mieterstrom model — does not oblige you to become their full electricity supplier.

The rules that push some owners out of EEG anyway

Under the EEG 2025 framework, larger new systems are moved into direct marketing rather than the fixed tariff (the threshold discussed for new systems is 25 kWp), remuneration is dropped to zero during hours of negative exchange prices, and systems must be remotely controllable so output can be curtailed (§9 EEG). If you are being pulled into direct marketing and technical curtailment regardless, the practical gap between "with EEG" and "without EEG" narrows — the comparison then is marketing revenue versus market premium, not tariff versus nothing.

When going without EEG actually pays — and when it does not

It tends to pay when your own load profile absorbs most of the generation (workshops, farms, cold stores, offices with daytime demand), when a creditworthy offtaker will sign a PPA above the tariff level, or when you supply users in your own building. It rarely pays for a small roof with low daytime consumption and no battery, because you then trade a guaranteed 20-year payment for volatile market revenue. Run the numbers on your measured load profile, not on a rule of thumb, and check with your grid operator which metering concept your chosen route requires before ordering hardware.
